If you do not agree to these terms, you must immediately cease using this Website.

2.1 All content displayed on this Website—including trademarks, logos, brand architecture, graphics, text layouts, product design briefs, and software concept models—is the sole and exclusive property of KePAY (Pty) Ltd.

2.2 You are strictly prohibited from copying, scraping, reproducing, replicating, or using any elements of KePAY's brand identity or proprietary technical workflows without our express, prior written authorization.

Acceptable Use & Platform Tampering

You agree to use this Website strictly for lawful commercial purposes. You covenant that you will not:

  • Use any automated data-gathering scripts, bots, or scrapers to harvest information from our pages.
  • Utilize our contact or demo submission forms to transmit malicious code, phishing scripts, or spam.
  • Attempt to bypass, probe, or test the vulnerability of our website firewalls, server perimeters, or cloud data networks.

(Note: Live platform software operations, metrics, and security guarantees are governed exclusively by our separate, signed corporate Master Service Level Agreements and POPIA Data Processing Agreements, not by these website parameters).

To the maximum extent permitted by South African law, KePAY (Pty) Ltd shall bear no financial or operational liability for any direct, indirect, incidental, or consequential damages resulting from your use of, or inability to use, this Website. This includes, without limitation, any losses arising from network latency, local internet service provider (ISP) failures, or malicious third-party cyber threats.

Breach and Account Suspension

We reserve the right to immediately track, block, and permanently suspend any IP address or user account that displays malicious activity, automated brute-force entry patterns, or any violation of these terms. Any unauthorized backend access attempts will be aggressively reported to the South African Police Service (SAPS) Cybercrime Unit under the Cybercrimes Act No. 19 of 2020.

Amendments & Governing Law

KePAY reserves the right to update these terms at any time to align with technical architecture or legislative shifts. These terms are governed entirely by and interpreted according to the laws of the Republic of Southern Africa. Any legal disputes arising from website usage shall be referred to private, expedited arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA) in Johannesburg.
